Legal DefinitionsSexual Conduct"Vaginal intercourse between a male and a female, and anal intercourse, fellatio, and cunnilingus between persons regardless of sex; and the insertion, however slight, of any part of the body or any instrument, apparatus or other object into the vaginal or anal cavity of another. Penetration, however slight, is sufficient to complete vaginal or anal intercourse." Sexual Contact"Any touching of an erogenous zone of another, including without limitation the thigh, genitals, buttock, pubic region, or, if the other person is female, a breast, for the purpose of sexually arousing or gratifying either person." Rape"No person shall engage in sexual conduct with another... (when) for the purpose of preventing resistance, the offender substantially impairs the other person's judgement or control by administering any drug or intoxicant to the other person, surreptitiously or by force, threat of force, or deception; (or when) the other person is less than thirteen years of age, whether or not the offender knows the age of such person; (or when) the offender purposely compels the other person to submit by force or the threat of force." Sexual Battery"No person shall engage in sexual conduct with another... (when) the offender knowingly coerces the other person to submit by any means that would prevent resistance by a person of ordinary resolution; (or) the offender knows that the other person's ability to appraise the nature or control his or her own conduct is substantially impaired; (or) the offender knows that the other person submits because he or she is unaware that the act is being committed;... (or) the offender is the other person's natural or adoptive parent or a stepparent, or guardian, custodian, or person in loco parentis; (or) the other person is in custody of law or a patient is a hospital or other institution, and the offender has supervisory or disciplinary authority over such other person." Unlawful Sexual Conduct with a Minor"No person who is eighteen years of age or older shall engage in sexual conduct with another... when the offender knows such other person is at least thirteen years of age but less than sixteen years of age, or the offender is reckless in that regard." Gross Sexual Imposition"No person shall have sexual contact with another, or cause two or more other persons to have sexual contact when, the offender puposely compels the other person(s) to submit by force or threat of force." Sexual Imposition"No person shall have sexual contact with another, or cause two or more other persons to have sexual contact, when the offender purposely compels the other person(s) to submit by force or threat of force (when) Offender knows that such behavior is offensive to the other person(s)." Testimony of a witness is needed. |
